When utilizing any services provided by Wexa.ai, you are hereby accepting and agreeing to the latest Terms of Service outlined herein ("Terms"). Any breach of these terms may lead to the discretionary termination of your Wexa.ai account.
Please be aware that Wexa.ai reserves the right to update these Terms & Conditions at its discretion. In the event of significant changes, we will update the date at the top of this page. It is your responsibility to stay informed about any modifications to the Terms & Conditions by reviewing this page periodically.
Definitions
For the purposes of these policies and terms, the terms "Company," "we," "our," or "us" shall refer to Wexa.ai.
The term "Services" encompasses our websites, which include wexa.ai, as well as any products developed and maintained by Wexa.ai through a web browser, desktop application, mobile application, or other formats.
In the context of these terms, "you" or "your" pertains to individuals or organizations that hold an account with one or more of our Services.
Access & Security Terms:
As a user of Wexa.ai services, it is your responsibility to uphold the security of your account and password, as well as ensuring that all users associated with your account adhere to the same standards. Wexa.ai shall not be held liable for any loss or damage resulting from your failure to meet these security obligations.
All content posted and activities undertaken under your account, including those initiated by other users within your account, are your responsibility. It is essential that you confirm the human identity of the account holder, as accounts registered by "bots" or other automated methods are not allowed.
The utilization of Wexa.ai Services is strictly prohibited for any purposes outlined in User Conduct Guidelines. You are not permitted to allow any of your users to engage in such activities.
Account Billing & Refund Processes:
- For users of our free versions, rest assured that it is genuinely free, and we neither request your credit card details nor engage in selling your data.
- In the case of paid Services offering a free trial, the trial period's duration is communicated upon sign-up. Post the trial period, continued use of the Service requires advance payment. Failure to make payment will result in the freezing of your account, rendering it inaccessible until payment is received. Accounts frozen for an extended period will be queued for auto-cancellation.
- If you decide to upgrade from a free plan to a paid plan, immediate card charges will be incurred, and the billing cycle commences on the upgrade day. For other plan level upgrades or downgrades, the new rate becomes applicable from the subsequent billing cycle.
- All fees mentioned are exclusive of any taxes or duties imposed by taxing authorities. If required, we will collect and remit those taxes on behalf of the taxing authority, otherwise, you are responsible for the payment of all applicable taxes or duties.
- Should you find yourself dissatisfied with any of the Services or products offered by Wexa.ai for any reason whatsoever, we encourage you to reach out to our dedicated support team at support@wexa.ai. Feel free to contact our support team at any time, and we will diligently work towards resolving your concerns and providing the necessary assistance. Your experience and satisfaction are of utmost importance to us.
Cancellation and Termination:
- It is your sole responsibility to properly cancel your Wexa.ai account. It's important to note that an email or phone request alone is not automatically considered a cancellation. If you require assistance with canceling your account, our Support team is available to help at support@wexa.ai
- Upon cancellation of your account, all your content will be immediately inaccessible from the Services. Within 30 days, all content will be permanently deleted from active systems and logs. After 60 days, all content will be permanently removed from our backups, and recovery of this information is not possible once deleted.
- If you cancel the Service before the end of your current paid-up month, your cancellation takes effect immediately, and you will not be charged again. Unused time in the last billing cycle is not automatically prorated. Refer to our Refund Policy for more details.
- Wexa.ai reserves the right to suspend or terminate your account, denying any current or future use of our Services, for any reason and at any time. Suspension means you and other users on your account will lose access to the account and its content. Termination entails the deletion of your account, access, and all content within it. Additionally, we retain the right to deny Service use to anyone at any time, including instances of violating our User Conduct Guidelines.
- Immediate account termination will result from verbal, physical, written, or other abuse, including threats, directed towards a Wexa.ai employee or officer.
Service Revisions & Price Updates:
- At Wexa.ai, our commitment is to support our Services for as long as it remains both feasible and reasonable, extending our dedication as per the Support Commitment. This assurance encompasses the areas of security, privacy, and customer support, wherein we will diligently maintain legacy Services. While we strive to uphold our Services consistently, there are instances where technical limitations or the pursuit of improved functionality may necessitate discontinuation of certain features or a redesign of specific Service components. Additionally, we may choose to close new signups. It is essential to note that we retain the right to modify or discontinue any part of our Services, either temporarily or permanently, with or without prior notice.
- Occasionally, adjustments to the pricing structure of our products may occur. In such cases, our general approach is to exempt existing customers from these alterations; however, there may be instances where changes affect current customers. If any modifications are made to the prices for existing customers, we commit to providing a minimum of 30 days' notice. Notifications will be sent to the email address on record, and we may also post notices about changes on our websites or the affected Services themselves.
Intellectual Property & Content Rights:
- By posting content on our Services, you grant us a limited license to utilize the content for the purpose of providing you with the Services. However, we do not assert any ownership rights over the materials you submit; they remain exclusively yours.
- While we do not pre-screen content, we retain the right, at our sole discretion, to refuse or remove any content available via the Service.
- Wexa.ai or its licensors hold all rights, title, and interest in and to the Services, including all intellectual property rights. Your use of the Services does not confer any ownership rights upon you. Replicating, copying, or reusing any part of the HTML, CSS, JavaScript, or visual design elements without explicit written permission from Wexa.ai is strictly prohibited. Requests for the use of the Company’s logos or any Service logos for promotional purposes should be emailed to us, and permission must be granted. We reserve the right to revoke permissions if you violate these Terms.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of Wexa.ai.
Service API Usage & Terms :
- Wexa.ai provides Application Program Interfaces ("APIs") for specific Services. Any utilization of the API, whether directly or through a third-party product accessing the Services, is subject to these Terms and the subsequent specific terms outlined below:
You explicitly acknowledge and agree that the company bears no liability for any damages or losses resulting from your use of the API or third-party products accessing data via the API.
Third parties are prohibited from accessing and deploying the API if the functionality is integrated into an application that remotely records, monitors, or reports a Service user's activity, excluding time tracking. The company, at its sole discretion, will determine violations of this provision. Any third party found to have developed and implemented an integration for the purpose of remote user surveillance will be required to discontinue that integration.
Abuse or excessively frequent requests to the Services through the API may lead to the temporary or permanent suspension of your account's API access. Determination of abuse or excessive usage rests solely with the company. In cases where account access suspension is deemed necessary, the account owner will be alerted if feasible. If your API usage is or could potentially cause downtime, access may be terminated without prior notice.
Various third-party providers could create integrations between our Services and theirs. The company is not liable or accountable for any of these third-party integrations.
Liability:
By using Wexa.ai's Services, you acknowledge that the company holds no liability to you or any third party for damages arising from Service usage, the inability to access data, or unauthorized access to your data or account. Additionally, the company is not responsible for damages of any nature associated with the actions of third parties utilizing the Services or any other outcomes related to the Terms or Services.
